Supreme court slams states & dog lovers: Govt to pay hefty compensation if stray dogs bite

New Delhi (The Uttam Hindu): "Are your feelings only for dogs, not for humans?" The Supreme Court today posed this stinging question to dog lovers and organizations that advocate for the rights of stray dogs. In a historic and stern stance, the court made it clear that if stray dogs bite someone, not only the government but also those who feed them will be held responsible.

'State governments should be prepared to pay huge compensation'

A bench of Justices Vikram Nath, Sandeep Mehta, and NV Anjaria made sharp remarks during the hearing. The court clearly warned that state governments would be required to pay substantial compensation to victims of dog bite deaths and injuries. The court even questioned why stray dogs should be allowed to roam freely on the streets and cause nuisance.

"If you love me, take me home"

The Supreme Court also hinted at holding so-called "dog lovers" and the organizations representing them accountable. The court stated bluntly, "If you love dogs so much and want to protect them, keep them in your home or premises. If you cannot do so, you will be held responsible for any harm they cause." The court asked who would be held responsible for the death of a 9-year-old child?

The judge commented: "I have never heard such passionate arguments for human beings"

During the hearing, when a lawyer made an impassioned argument for measures like adopting and tracking stray dogs, Justice Sandeep Mehta interrupted him. He said, "I wish someone could make such arguments for orphans. I was appointed a judge in 2011, but I have never heard such impassioned arguments for humans." He clarified that empathy shouldn't be limited to animals.

Now will a big decision be taken on January 20?

Senior Advocate Arvind Datar argued that the current ABC rules (Animal Birth Control) violate several central and state laws. The court stated that when the central and state governments present their views at the next hearing, they will be asked very serious questions. The hearing was originally scheduled for January 15th, but at the request of lawyers, the next date has now been set for January 20th, a date the entire country will be watching.
