Big move: BJP-ruled states plan strict law against halala, jail and fines proposed
BJP-ruled states plan strict action against halala with proposed fines and imprisonment to protect Muslim women.

New Delhi (The Uttam Hindu): The Gujarat government has introduced the “Gujarat Uniform Civil Code 2026” bill in the Assembly, marking a significant step toward implementing a common legal framework in the state. The proposed law aims to replace personal laws based on religion or caste in matters such as marriage, divorce, inheritance, and live-in relationships, with the objective of ensuring equal rights and promoting social justice.
The bill includes strict provisions regarding practices like halala, with a proposal to prohibit it. It allows divorced couples to remarry without conditions, including between former spouses. Any violation of this provision could attract a jail term of up to three years or a fine of up to one lakh rupees. The government says these measures are intended to safeguard the dignity and rights of women.
It also lays down clear rules for marriage by banning bigamy and setting the minimum age at 21 for men and 18 for women. In addition, the bill proposes mandatory registration of live-in relationships, bringing them under a formal legal structure.
The legislation follows recommendations from a committee that submitted its report to Chief Minister Bhupendra Patel. Described by officials as a major reform, the bill will be taken up for discussion on March 24 and is likely to be passed by the end of the budget session. While supporters view it as a move toward equality and modernization, critics argue it could interfere with traditional practices, setting the stage for a wider debate.
