CJI Surya Kant's historic decision on 'legal emergency', court to remain open 24 hours for justice

New Delhi (The Uttam Hindu) : Chief Justice of India (CJI) Surya Kant has made a significant decision regarding the functioning of the Supreme Court and High Courts. He clarified that in the event of a legal emergency, any citizen can approach the court at any time, even in the middle of the night.
According to CJI Surya Kant, if a person is threatened with arrest by investigating agencies and their fundamental rights are immediately threatened, courts can conduct hearings beyond time constraints. He said, “I am trying to ensure that the Supreme Court and High Courts are always accessible to the public. Individuals in legal emergencies can get justice even when regular proceedings are suspended.”
Emphasizing Constitutional Benches to Resolve Pending Cases, CJI Surya Kant acknowledged that a large number of petitions are pending in the courts. For their speedy disposal, there is a need to form more Constitutional Benches. He explained that pending cases also include disputes related to Special Intensive Revision (SIR). After Bihar, the SIR process is underway in 11 states across the country, which has been challenged in court.
A nine-member bench is being considered for the Sabarimala case
CJI Surya Kant noted that a petition is also being filed challenging the Supreme Court's decision allowing women of all ages to enter the Sabarimala temple. This case involves the balance between religious freedom and women's rights, and a nine-member Constitutional Bench is being considered.
Strict deadlines for lawyers
The Chief Justice also issued new guidelines for lawyers. He stated that lengthy arguments will not be permitted in important cases. Now, lawyers in the Supreme Court must complete oral arguments within the prescribed time limit, and this will be strictly enforced.
