Supreme Court’s Sharp Remark in Rape Case: “Why Did You Go When He Called You?”

New Delhi (The Uttam Hindu): The Supreme Court on Wednesday upheld the anticipatory bail of a man accused of having sexual relations with a woman by promising to marry her. At the same time, the court reprimanded the woman and said that she has committed a crime by having an extra marital affair. The court also warned the woman that she can be prosecuted if she has physical relations with any man other than her husband during marriage.
According to media reports, a bench of Justice MM Sundaresh and Justice N Koteshwar Singh was hearing the petition. The court has warned the woman that she can also be prosecuted for having a relationship with someone other than her husband while being married. It has also said that she has committed a crime by having a relationship outside marriage. The lawyer appearing in the court on behalf of the woman said that the man kept having physical relations with the woman by making false promises of marriage. On this, the court told the woman, 'You are a married woman and you have two children. You are mature and you understand that the relationship you are going to make is outside marriage.' The lawyer also said that the man had called the woman to the hotel several times to have physical relations. The court said, 'Why did you go to the hotel again and again on his request? You know very well that you have also committed a crime by having physical relations outside marriage.'
Let us tell you that the woman and the accused met through social media in the year 2016. Both have been in a relationship since then. The woman alleged that she divorced her husband under pressure from her partner, which was also approved by the Family Court on March 6. Immediately after the divorce, the woman asked him to marry her, but he refused. Angered by this, the woman lodged a complaint with the Bihar Police. She alleged that the man sexually harassed her by making false promises of marriage. Later, when the matter reached the court, the Patna High Court granted bail to the man. The High Court found that both of them have not been involved in any physical activities since the woman's divorce.
