Using a SIM card registered in someone else's name will now prove costly. If caught, the offender can face up to three years in jail and a fine of Rs 50 lakh.

New Delhi (The Uttam Hindu): With mobile numbers now linked to bank accounts, UPI transactions, financial services and sensitive OTPs, the Department of Telecommunications (DoT) has warned citizens against obtaining SIM cards through fake identities or unauthorised use of another person’s documents. The department has stated that fraudulently obtaining or misusing telecom identifiers is a serious offence under the Telecommunications Act, 2023.

Under Section 42(3)(e) of the Telecommunications Act, 2023, a person found guilty of activating a SIM through fraud, deception or unauthorised use of another person’s identity can face imprisonment of up to three years, a fine of up to ₹50 lakh, or both. The law also provides for action against those who assist, attempt or conspire to commit such offences. This includes individuals or businesses involved in facilitating the issuance of SIM cards through fraudulent documents.

The DoT has advised mobile users to regularly check the telecom connections registered in their name through the government’s Sanchar Saathi portal or app. Users can review the active mobile connections associated with their identity and report any number they do not recognise. Taking such action can help prevent the misuse of personal identity and reduce the risk of potential fraud or legal complications.
