Washington (The Uttam Hindu): US President Donald Trump's trade policies have suffered a severe legal blow, reverberating through markets worldwide. For the first time in American trade history, such a significant upheaval is being witnessed, with the government facing the prospect of paying billions of dollars in refunds due to its own policies. This issue is not limited to a political defeat; it will directly impact companies that trade with the US and the global economy.

Companies get big relief from the court

Richard Eaton, a federal judge in New York, recently issued a significant ruling, providing significant relief to companies engaged in foreign trade. He clarified that all companies that paid illegal tariffs (import duties) imposed by the government are entitled to a refund. This entire dispute concerns the hefty taxes imposed under the International Emergency Economic Powers Act (IEEPA) of 1977. Just last month, the US Supreme Court struck down the Trump administration's double-digit import duties, declaring them unconstitutional. Now, Judge Eaton has clarified that the scope of the refund will not be limited to the few companies that approached the court, but will apply equally to all importers who paid duties under this emergency law.

The government treasury will suffer a huge loss of Rs 16 lakh crore

The financial impact of this court decision is extremely worrying for the US government. Data shows that by mid-December, the US government had collected a staggering $130 billion (approximately ₹12 lakh crore) through these disputed tariffs. It is estimated that if the collections made after December are also included, the total refund could reach ₹175 billion, or approximately ₹16.12 lakh crore. The court issued this order while hearing the case of Tennessee-based filter manufacturer Atmos Filtration. The Trump administration had made every legal effort to slow down this refund process, but the US Court of Appeals flatly rejected the government's argument.

Trump administration strikes back, 15% tax a new weapon

The US government is not about to sit back after this strategic defeat in court. US Treasury Secretary Scott Bessent has indicated that the administration is going to further harden its stance. The new 10% universal tariff that Trump implemented after the Supreme Court's decision is now being prepared to be increased to 15%. According to the Treasury Secretary, this new tax slab could be officially announced this week. However, under current legal provisions, this new tariff structure can only remain in effect for 150 days.

Will the old strict rules of business return again?

Following this entire development, US officials now have only five months left. In this short period, they are exploring new legal options to reinstate the old tariff rates. The Treasury Secretary believes that while the implementation process for tariffs under Section 301 and Section 232 may be slower, they are legally stronger and more sustainable. Consequently, further major changes to US trade policies may be expected in the coming days.
